Waste Removal Swiss Cottage Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Swiss Cottage provides waste collection and related services in and around the Swiss Cottage area. By placing a booking, confirming a quotation or allowing our team to collect waste from your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, organisation or other entity requesting or receiving waste removal or associated services.

Company means Waste Removal Swiss Cottage, the waste collection service provider.

Services means any waste removal, collection, loading, transportation, clearance or related services provided by the Company.

Waste means any items, materials, rubbish, refuse, junk, furniture, appliances, garden waste or other materials agreed to be removed by the Company, excluding any prohibited or hazardous items that the Company is not authorised to carry.

Site means the property, premises or location from which the Company is instructed to remove Waste.

2. Scope of Services

The Company provides waste removal and collection services, including but not limited to domestic and commercial waste collection, bulky waste removal, garden clearances, and general rubbish removal in the Swiss Cottage service area and surrounding districts. Services are provided subject to availability and to these Terms and Conditions.

The exact scope of the Services for a particular job will be confirmed in the quotation or booking confirmation, including the type and approximate volume of Waste to be removed, any access requirements and any specific instructions given by the Customer and accepted by the Company.

3. Booking Process

Bookings can be made by telephone, email or other contact methods as indicated by the Company. When making a booking, the Customer must provide accurate information, including:

1. The address of the Site and any access details.

2. A description of the Waste to be collected, including approximate quantities, sizes and types of items.

3. Any known restrictions at the Site, including parking limitations, building access requirements or time restrictions.

4. The preferred date and time window for collection.

The Company may request photographs or further details to provide an accurate quotation. Any quotation is based on the information supplied by the Customer and may be subject to change if the actual Waste or access conditions differ substantially from those described at the time of booking.

A booking is only confirmed when the Company has issued a booking confirmation and, where required, received any applicable deposit or pre-payment. The Company reserves the right to refuse or cancel any booking at its discretion, including where providing the Services would be unsafe, unlawful or not reasonably practicable.

4. Access and Site Requirements

The Customer is responsible for ensuring safe, reasonable and lawful access to the Site for the Company’s vehicles and team for the duration of the booking. This includes:

1. Ensuring sufficient parking or loading space is available close to the Site.

2. Obtaining any permits, permissions or authorisations required for parking, loading or access.

3. Ensuring the Waste is accessible, not obstructed and safe to handle.

If the Company is unable to carry out the Services due to inadequate access, unsafe conditions or missing permissions, the Company may charge a call-out fee and any reasonable costs incurred. The Customer should notify the Company in advance of any potential issues with access.

5. Waste Types and Restrictions

The Company will only remove Waste that it is lawfully permitted and properly equipped to handle. Certain items and materials are restricted or prohibited, including but not limited to:

1. Hazardous or dangerous waste, such as chemicals, solvents, asbestos, medical or clinical waste, corrosive substances, gas cylinders, explosives and radioactive materials.

2. Liquid waste, including oils, fuels, paints and similar substances, unless expressly agreed in writing.

3. Any waste for which the Customer cannot provide suitable documentation where legally required.

The Customer must inform the Company before collection if any Waste could be hazardous or require special handling. If prohibited or hazardous items are discovered during collection, the Company may refuse to remove them, adjust the quotation, or suspend the Services. The Customer remains responsible for any non-compliant or undisclosed hazardous waste.

6. Pricing and Quotations

Prices for the Services are generally based on factors such as the type and volume of Waste, the weight where applicable, labour required, access conditions, and any disposal or recycling fees. The Company may provide an initial quotation based on information supplied by the Customer and confirm or adjust the price upon arrival at the Site after assessing the Waste.

If the actual Waste or access conditions differ significantly from the description provided at booking, the Company will inform the Customer and may offer a revised quotation. If the Customer does not accept the revised quotation, the Company may cancel the job and charge a reasonable call-out fee to cover time and travel costs.

Unless expressly stated otherwise, all prices are quoted in pounds sterling and may be subject to applicable taxes. The Company reserves the right to change its pricing structure and rates from time to time.

7. Payment Terms

Unless otherwise agreed in writing, payment is due in full on completion of the Services at the Site. The Company may accept payment by cash, card or other agreed payment methods. For business Customers or account Customers, alternative invoicing and payment terms may be agreed in advance.

If payment is not received when due, the Company may:

1. Withhold provision of further Services until payment is made in full.

2. Charge interest on overdue amounts at a reasonable rate, from the due date until the date of actual payment.

3. Take reasonable steps to recover the outstanding amounts, including the use of debt collection agencies, and recover from the Customer any costs incurred in doing so.

8. Cancellations and Amendments

The Customer may cancel or amend a booking by contacting the Company as soon as reasonably possible. The following cancellation terms will generally apply:

1. If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged.

2. If the Customer cancels within 24 hours of the scheduled collection time, the Company may charge a cancellation fee to cover lost time and costs.

3. If the Customer cancels after the team has been dispatched or on arrival at the Site, the Company may charge a call-out fee and any other reasonable costs incurred.

The Company will make reasonable efforts to accommodate requests to reschedule or amend bookings, subject to availability. If the Customer requests significant changes that affect the scope of the Services, the price may be adjusted accordingly.

9. Customer Obligations

The Customer agrees to:

1. Provide accurate and complete information when making a booking.

2. Ensure the Waste presented for collection matches the description provided.

3. Ensure safe and reasonable access to the Site and Waste.

4. Comply with relevant local regulations, property rules and any instructions given by the Company for safe service delivery.

5. Not request the Company to remove any prohibited or illegal items.

If the Customer is not present during the collection, they must ensure the Company has clear instructions and access arrangements in place. The Customer remains responsible for any charges incurred as a result of incomplete or inaccurate instructions.

10. Performance of Services

The Company will use reasonable care and skill in providing the Services and will make reasonable efforts to arrive within agreed time windows. However, all times are estimates and may be affected by traffic, weather, operational issues or other circumstances beyond the Company’s control.

If the Company expects to be significantly delayed or unable to attend a booking, it will make reasonable efforts to inform the Customer and arrange an alternative time. The Company will not be liable for minor delays or changes in timing, provided the Services are completed within a reasonable period.

11. Disposal and Recycling

The Company will transport collected Waste to licensed facilities for disposal, re-use or recycling in accordance with applicable waste management laws and regulations. The Company aims to minimise landfill where reasonably possible by directing suitable materials to recycling or recovery facilities.

Upon completion of the Services and payment in full, ownership and responsibility for the Waste collected will pass from the Customer to the Company, subject to any legal or regulatory restrictions. The Company may, at its discretion, sort or separate Waste to maximise recycling and recovery, without any obligation to share proceeds from any recovered materials with the Customer.

12. Liability and Limitations

The Company will take reasonable care when carrying out the Services at the Site. However, the Customer is responsible for protecting fragile items, flooring, walls and fixtures and for informing the Company of any particular risks or sensitivities at the Site.

The Company’s liability for any loss or damage arising out of or in connection with the Services is limited as follows:

1. The Company will not be liable for any loss or damage that is not reasonably foreseeable when the contract is formed.

2. The Company will not be liable for indirect or consequential losses, including loss of profit, loss of business or loss of opportunity.

3. The total liability of the Company to the Customer for any claim arising from a single booking will not exceed the total price paid or payable for that booking, except where liability cannot legally be limited.

Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot be excluded or limited under applicable law.

13. Complaints

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing full details of the issue. The Company will review the complaint, investigate where necessary and seek to resolve the matter promptly and fairly.

The Customer should raise any concerns regarding alleged damage to property or incomplete work within a reasonable time of the Services being carried out, and where possible provide supporting evidence to assist the investigation.

14. Data Protection and Privacy

The Company may collect and process personal data from the Customer in order to manage bookings, provide the Services, handle payments and communicate with the Customer. Such data will be handled in accordance with applicable data protection laws and used only for legitimate business purposes connected to the provision of waste removal services.

The Customer is responsible for ensuring that any personal data provided is accurate and for informing the Company of any necessary updates or corrections.

15. Force Majeure

The Company will not be liable for any delay in performing, or failure to perform, its obligations under these Terms and Conditions where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to severe weather, road closures, accidents, strikes, power failures or acts of government or public authorities.

In such circumstances, the Company will use reasonable efforts to resume performance as soon as practicable and may offer to reschedule the Services where appropriate.

16. Variation of Terms

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that booking. Customers are encouraged to review the Terms and Conditions periodically to stay informed about any changes affecting future bookings.

17. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to hear and determine any disputes arising in connection with these Terms and Conditions or the Services provided by the Company.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by the Company, constitute the entire agreement between the Customer and the Company relating to the provision of waste removal and collection services in the Swiss Cottage service area. They supersede any prior understandings, statements or agreements, whether oral or written, relating to the same subject matter.

By confirming a booking or allowing the Company to proceed with the Services, the Customer acknowledges that they have read, understood and agree to these Terms and Conditions.
